1. Acceptance of Terms By accessing and using the services provided by Blyxxa LLC (“Blyxxa,” “we,” or “us”), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.
2. Description of Service & The BYOK Model Blyxxa provides AI-powered content generation tools and strategy guides. Our platform operates on a “Bring Your Own Key” (BYOK) model.
- API Costs: You acknowledge that you are solely responsible for obtaining valid API keys (e.g., from OpenAI or Google) and for paying any usage fees directly to these third-party providers. Blyxxa is not responsible for any charges incurred on your external API accounts while using our tools.
- Functionality: The quality and speed of generation depend on the status of third-party API services, over which we have no control.
3. Disclaimer of Warranties (AI Hallucinations) Our tools utilize advanced Artificial Intelligence models. While we employ proprietary “Blyxxa Protocols” (E.A.A.T & B.E.A.T) to minimize errors and maximize quality:
- Accuracy: AI can occasionally produce incorrect, misleading, or offensive information (“hallucinations”). You acknowledge that Blyxxa provides these tools “as is.”
- User Responsibility: You agree that you are the “Pilot” and the final editor. It is your sole responsibility to review, fact-check, and approve any content generated by our tools before publishing or using it for business purposes. Blyxxa accepts no liability for the consequences of using the generated content.
4. User Conduct & Community Guidelines Since Blyxxa includes community features (profiles, directories, messaging), you agree to use these features responsibly. You agree NOT to:
- Harass or Bully: Use the messaging system or profile fields to harass, threaten, or intimidate other members.
- Spam: Send unsolicited promotional messages, spam, or “get rich quick” schemes to other users.
- Illegal Content: Upload profile photos or cover images that are offensive, pornographic, illegal, or violate intellectual property rights.
- Impersonate: Pretend to be a Blyxxa staff member or another user.
Violation of these guidelines may result in immediate account termination without refund.
5. Interaction with Other Users (Disputes)
- No Liability: Blyxxa LLC is not responsible for the conduct of any user on or off the service. You are solely responsible for your interactions with other members.
- Disputes: We reserve the right, but have no obligation, to monitor or become involved in disputes between you and other members.
6. Intellectual Property Rights
- Our Content: The interface, the underlying code, the proprietary prompt engineering strategies, templates, and methodologies provided by Blyxxa are the exclusive property of Blyxxa LLC. You may not reverse engineer, decompile, or attempt to extract the source code or prompts.
- Your Output: You retain full ownership of the text and content generated by you using our tools. You can use this content for personal or commercial purposes without attribution to us.
7. Payments and Refunds
- Subscription Fees: Access to Blyxxa tools is billed on a subscription basis (Monthly/Yearly).
- No Refund Policy: Due to the digital nature of our products (instant access to intellectual property and software tools), all sales are final. We do not offer refunds for partial months or unused services. You may cancel your subscription at any time to prevent future billing.
8. Limitation of Liability To the fullest extent permitted by law, Blyxxa LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of our service.
9. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
